These Terms & Conditions apply when you visit our website, purchase a product, book a Creative Experience, request custom artwork or a commission, or otherwise use the products and services offered by SK Artworks.

By using this website or purchasing from us, you agree to these Terms & Conditions.

Throughout these Terms, “we”, “us” and “our” refer to SK Artworks.

About SK Artworks

SK Artworks is an independent creative business based in the Northern Rivers, NSW, Australia.

Our online store is powered by Shopify, which provides the ecommerce platform we use to offer our products and services online.

Using Our Website

You agree to use this website only for lawful purposes.

You must not:

• Use the website in a way that could damage or interfere with its operation
• Attempt to gain unauthorised access to the website or another customer’s information
• Copy or reproduce website content without permission
• Use our artwork, images or designs for commercial purposes without written permission
• Upload or transmit malicious software, viruses or harmful code
• Use information from this website in a misleading or unlawful way

We may restrict or terminate access to the website where we reasonably believe these Terms have been breached.

Products & Artwork

We make reasonable efforts to accurately display our products, artwork and colours online.

However, colours and appearance may vary slightly depending on:

• Your device or screen
• Lighting
• Photography
• The handmade nature of a product or artwork

Original artwork and handmade pieces may contain natural variations that form part of the individual character of the work.

Product descriptions, prices and availability may be updated from time to time.

Original Artwork

Original artworks are individual, one-of-a-kind pieces.

Once an original artwork has been sold, it may no longer be available to another customer.

We reserve the right to remove, update or change the availability of artwork displayed on the website at any time.

The purchase of an original artwork gives you ownership of the physical artwork only.

Copyright and intellectual property rights remain with the artist unless otherwise agreed in writing.

Custom Artwork & Commissions

Custom artwork and commissions are created specifically for the individual customer.

Before work begins, we may discuss matters including:

• Subject matter
• Reference images
• Size
• Style
• Colour
• Materials
• Estimated completion time
• Price
• Delivery or collection requirements

Any quotation or agreement provided for a commission will apply alongside these Terms.

Creative Direction

We will work from the information, inspiration and references supplied by you while maintaining the artist’s individual creative style.

Because custom artwork is created by hand, an exact photographic or digital reproduction cannot be guaranteed.

Reasonable artistic interpretation and variation are part of the commissioning process.

Changes to a Commission

Please raise requested changes as early as possible.

Major changes requested after work has commenced may:

• Require additional time
• Incur additional charges
• Be unable to be accommodated once the artwork has reached an advanced stage

We will discuss any additional cost with you before completing significant additional work.

Customer-Supplied Images

You are responsible for ensuring you have permission to provide and use any photographs, logos, designs, images or other material supplied to us for a custom project.

You must not ask us to reproduce material in a way that unlawfully infringes another person’s copyright, trademark or other rights.

Murals & Larger Commissioned Projects

Murals and larger commercial or commissioned projects may require an individual quote and project agreement.

Additional matters may include:

• Site access
• Surface preparation
• Materials
• Travel
• Equipment
• Weather
• Working conditions
• Installation or painting dates
• Changes to the agreed design
• Delivery, freight or collection arrangements

Where a separate written quote or project agreement is provided, those project-specific terms will apply together with these Terms & Conditions.

Art Boxes

Art Boxes may contain a selection of creative materials such as canvases, paints, brushes, easels or other art supplies.

Exact contents will be described on the relevant product page.

Colours, brands or individual materials may occasionally be substituted with an equivalent product where necessary due to availability.

Art materials should be used in accordance with any instructions or warnings provided with the products.

Children should use art materials under appropriate adult supervision.

Creative Experiences

SK Artworks may offer Creative Experiences including:

• Sip & Paint events
• Kids Art Parties
• Private events
• Corporate events
• Workshops
• Other creative sessions

Booking details, inclusions, location, times and pricing will be provided on the relevant event or booking page.

Customers are responsible for checking the booking information before completing their purchase.

Children’s Events

Bookings for Kids Art Parties or other activities involving children must be made by a parent, guardian or responsible adult.

Parents, guardians or organisers remain responsible for providing any relevant information that may reasonably be required for the safe and appropriate delivery of the event.

Any specific supervision requirements will be communicated as part of the booking arrangements where applicable.

Event Cancellations & Rescheduling

Creative Experiences, events and workshops may be subject to separate cancellation or rescheduling conditions displayed at the time of booking.

If you can no longer attend, please contact us as soon as possible.

If SK Artworks needs to cancel or reschedule an event, affected customers will be contacted and advised of the available options.

Nothing in these Terms limits any rights available to you under Australian Consumer Law.

Orders

Placing an order through our website is an offer to purchase the selected product or service.

Your order is accepted once payment has been successfully processed and we confirm the order.

We reserve the right to cancel or decline an order where reasonably necessary, including where:

• An item is no longer available
• Incorrect pricing or product information has been displayed
• We reasonably suspect fraudulent activity
• We are unable to fulfil the order

If we cancel an order after payment has been received, the relevant amount will be refunded.

Please review your order carefully before completing checkout.

Prices & Payment

Unless otherwise stated, prices displayed on our website are in Australian dollars.

Prices may change without notice.

The price applicable to an order will generally be the price displayed at the time the order is submitted.

Any delivery costs that can be calculated at checkout will be shown before the order is completed.

For some large, oversized or custom artwork, shipping or freight may need to be quoted separately once the artwork is complete.

Payments are processed through Shopify and available third-party payment providers.

You agree to provide accurate billing, contact and payment information when placing an order.

Shipping, Delivery & Local Pickup

SK Artworks offers shipping on eligible products and may also offer local pickup in the Northern Rivers, NSW for selected orders.

Shipping & Delivery

Delivery estimates are provided as a guide only.

Delivery times may be affected by postal or courier delays, weather, public holidays, remote delivery locations and other circumstances outside our reasonable control.

Please ensure your delivery details are correct when placing your order.

If you notice an error in your delivery address, contact us as soon as possible.

Additional delivery charges caused by an incorrect address supplied by the customer may be the customer’s responsibility where permitted by law.

Large & Custom Artwork Delivery

Shipping or freight for large, oversized or custom-made artwork may not be included in the original purchase price.

Where the final shipping cost cannot reasonably be calculated before the artwork is completed, delivery will be quoted upon completion of the artwork.

The final shipping or freight cost will be calculated based on factors such as:

• Finished artwork dimensions
• Weight
• Protective packaging requirements
• Freight or courier requirements
• Delivery location

The customer will be advised of the final delivery cost before the artwork is dispatched.

Any outstanding shipping or freight charges must be paid before the artwork is sent.

Any shipping estimate provided before completion is a guide only unless it has been confirmed as a fixed delivery price in writing.

Customers may choose local pickup instead of shipping where this option is available.

Local Pickup

Where local pickup is available, this option may be selected at checkout or arranged directly with SK Artworks.

Customers will be contacted when their order is ready for collection.

Please do not arrive for collection until you have received confirmation that your order is ready.

Pickup is by arrangement from the Northern Rivers, NSW area.

The exact collection details and a suitable pickup time will be provided directly to the customer once the order is ready.

You may be asked to provide your name or order confirmation when collecting your order.

If someone else will be collecting the order on your behalf, please let us know beforehand.

Original artwork, Art Boxes, custom artwork and other eligible products may be available for local pickup depending on the individual order.

Collection of Custom Art & Commissions

Where custom artwork or a commission is being collected in person, collection will be arranged once the artwork is complete.

Any outstanding balance must be paid before or at the agreed time of collection unless another arrangement has been confirmed in writing.

Returns & Refunds

Returns and refunds are handled in accordance with our Returns & Refund Policy.

Change-of-mind conditions may differ between ready-made products, Art Boxes, original artwork and custom or commissioned pieces.

Custom and commissioned artwork is created specifically for the customer and is generally not eligible for change-of-mind returns once work has commenced.

Nothing in our Returns & Refund Policy or these Terms excludes your rights under Australian Consumer Law.

Intellectual Property

Unless otherwise stated, all original artwork, illustrations, sketches, designs, photographs of artwork, graphics, written content, branding and other creative material displayed on this website are owned by or licensed to SK SArtworks.

These materials are protected by applicable copyright and intellectual property laws.

You may not reproduce, copy, modify, distribute, sell, commercially use or create derivative works from our artwork or content without prior written permission.

Copyright in Purchased Artwork

Purchasing an original artwork or commissioned piece does not transfer copyright in the artwork to the purchaser unless this has been expressly agreed in writing.

The purchaser may display and enjoy the physical artwork for personal use.

The artwork must not be commercially reproduced, printed, licensed, copied onto merchandise or otherwise commercially exploited without written permission from SK Artworks.

Portfolio & Social Media

We may photograph completed artwork for our own records, portfolio, website or social media.

Where a custom piece contains private or personally identifying reference material, we will handle that material in accordance with our Privacy Policy and seek permission where appropriate before publicly sharing sensitive personal content.

If you have specific privacy requirements for a commission, please discuss these with us when placing your order.

Website Content

Information on this website is provided in good faith and may be updated from time to time.

We may correct errors relating to:

• Product descriptions
• Pricing
• Availability
• Event information
• Shipping information
• Website content

We reserve the right to correct genuine errors where reasonably necessary.

Third-Party Services & Links

Our website may contain links to or integrations with third-party services, including payment providers, social media platforms and other websites.

Third-party websites and services operate under their own terms and privacy policies.

SK Arworks is not responsible for the content or operation of third-party websites that we do not control.

Shopify

Our online store is powered by Shopify.

Shopify provides the ecommerce technology that allows us to offer products and services online.

Purchases made from SK Artworks are transactions between you and SK Artworks. Shopify provides the platform but is not the seller of our artwork, products or Creative Experiences.

Privacy

Personal information is handled in accordance with our Privacy Policy.

This includes information provided when:

• Purchasing products
• Making enquiries
• Booking events
• Requesting custom artwork
• Supplying reference images
• Joining our mailing list

Australian Consumer Law

Our goods and services come with rights and guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by law, SK Artworks will not be liable for indirect or consequential loss arising from use of this website or our products or services where that liability may legally be excluded.

Nothing in this section excludes or limits liability where doing so would be unlawful, including rights and remedies available under Australian Consumer Law.

Events Outside Our Control

We are not responsible for delays or inability to perform an obligation caused by circumstances reasonably outside our control.

These may include:

• Severe weather
• Natural disasters
• Transport disruptions
• Venue closures
• Illness
• Supply shortages
• Courier or freight delays
• Other unexpected circumstances

Where this affects an order, commission or event, we will communicate with affected customers and work towards a reasonable solution.

Changes to These Terms

We may update these Terms & Conditions from time to time.

The latest version will be published on this website and the “Last updated” date will be changed accordingly.

Terms applying at the time of an order or booking will continue to apply to that transaction unless otherwise required by law.

Governing Law

These Terms & Conditions are governed by the laws applicable in New South Wales, Australia.

Any dispute will be subject to the applicable laws and courts or tribunals of New South Wales, subject to any rights you may have under Australian consumer legislation.
